A
An opinion or estimate of a property’s value. If a buyer is unfamiliar with the value of real estate in an area, it is prudent to require that, as a condition of the earnest money contract, the property appraise for at least the price being paid. Also, lenders require an appraisal of property as a requirement of making a loan. The borrower will pay the appraisal fee.
B
One who is licensed by a state to act for principals in real estate transactions, within the scope of state law. In most states, including Texas, one must be licensed as a broker to act in a real estate transaction for another. A licensed real estate salesperson must be sponsored by a broker who accepts responsibility for the salesperson’s acts. A broker is regulated by the law of agency, which requires the broker to act in the best interest of the principal.

Formal transfer of ownership from seller to buyer. The sales contract will set a date for the closing. At that time, if the date is not changed, a meeting of buyer and seller, plus agents, attorneys, lenders and other interested persons, is held. At the meeting, all fees and commissions are paid, the loan is advanced, legal documents are signed and all transaction expenses, including the buyer’s down payment, are paid out of funds supplied by the buyer and seller. After closing and funding, the buyer is the owner of the property.
In a real estate transaction, amounts charged to transfer ownership. Generally includes brokerage commissions, discount points and other loan fees, appraisal and credit check fees, attorney fees, title expenses and recording fees. In a residential real estate transaction these easily can exceed 10 percent of the selling price.
1. Amount earned by a real estate broker for services rendered. Commissions are the way real estate brokers earn money. 2. The official body that enforces real estate license laws. The Texas Real Estate Commission licenses brokers and salespersons and may suspend a license for certain behavior.
An evaluation of the credit worthiness of an individual based on their credit history. Mortgage loan approval may be difficult to obtain without a favorable credit rating or with no credit rating. Someone who has never borrowed money may have as much difficulty obtaining credit as a person who has a poor credit history.

A clause in a deed that limits the use of the property. For example, a deed might stipulate that alcoholic beverages are not to be sold on the land for 20 years. A prospective buyer should check that deed restrictions would not inhibit an intended use of property; a prospective seller should consider whether he or she wants to restrict the use of land.
Amounts paid to the lender at the time of a loan origination, to account for the difference between the market interest rate and the lower face rate of the note. They are often required when FHA or VA financing is used. Each point is 1 percent of the loan principal. Discount points must be paid in cash at closing. Buyer and seller should agree, at the time they prepare an earnest money contract, who is to pay them.
Cash payment needed to make up the difference between the amount borrowed and the price of a property. Few mortgage loans cover the complete cost of a property, even when supplemented with junior mortgages. The borrower most likely will have to contribute cash, partly to pay for transaction costs and partly to make the down payment. Down payments often are substantial, equaling thousands or tens of thousands of dollars.

The right, privilege or interest that one party has in the land of another, such as the right of public utility companies to lay their lines across another’s property. Easements allow utility service without requiring the public utility to buy the land. However, a potential real estate purchaser should determine exact locations of all easements to be sure they will not interfere with planned land uses.
The right of the government or a public utility to acquire property for necessary public use by condemnation; the owner must be fairly compensated. Governments or those with governmental authority can acquire property they need under the Fifth Amendment and state constitutions. The amount of compensation is negotiable.
An agreement between two or more parties providing that certain instruments or property be placed with a third party for safekeeping, pending the fulfillment or performance of some act or condition. It is prudent to place money or property in escrow, rather than giving it to the other principal in a pending transaction.

A periodic charge required of all homeowners within the association’s jurisdiction. The fee pays to maintain common areas and support the efforts of the association. See condominium fee and maintenance fee. Homeowners’ associations often are organized by a condominium or subdivision developer to be turned over to the homeowners when all the units or homes are sold. In a subdivision, the association may maintain common recreational facilities, or the association may serve merely to enforce deed restrictions. Each homeowner who buys in the subdivision agrees to abide by the strictures and to pay fees to the association when accepting the deed to the property.

A charge to help defray the costs of originating a loan. The fee is paid by the borrower at closing as a specific percentage of the amount borrowed. See Discount points. Mortgage loan terms often are quoted as “8 percent with 1 plus 2 points.” This means that three discount points (equal to 3 percent of the loan amount) will be charged with one of the points considered a loan origination fee. If the origination fee is charged to pay for specific services, such as an appraisal or credit check, it may not be included in tax deductible interest expenses.

The highest price a buyer, willing but not compelled to buy, would pay, and the lowest price a seller, willing but not compelled to sell, would accept. Many conditions are assumed to exist, including: 1. Open and competitive market; 2. Typically motivated principals, acting prudently and knowledgeably; 3. Normal time on the market for the type of property; 4. Payment to seller in cash or equivalent; 5. Buyer may arrange typical financing terms available in the market. In theory, property would sell for its market value if exposed to the market for a sufficient time.

The amount of money remaining to be paid on a loan. Also, the client of a brokerage agent; the person who engages an agent by contract. The principal of a loan determines how much interest must be paid. During the term of a mortgage loan, the principal declines and less of each payment is interest. The principal of an agent is the person the agent serves, who is most often the seller unless the buyer has made specific arrangements with an agent.

A charge levied upon persons or things by a government. Many different taxes affect real estate. Most local governments levy an ad valorem tax based on property value. The federal government and many states have an income tax, but rental property owners may claim operating expense, interest and depreciation expense to reduce their taxable income.
V
The worth in money of all the rights arising from ownership; the quantity of one thing that will be given in exchange for another. Price is the historic amount that was paid; value is an estimate of what it is worth. Often value is qualified as to a specific type: market, user, assessed, insurable, speculative and so on.

Persona apoderada a fin de actuar a nombre de otra en asuntos legales. El tenedor del gravamen afectando una propiedad o su titularidad respectiva, en garantÃa de un adeudo. El acreedor hipotecario es el que recibe la hipoteca; el deudor hipotecario es el que recibe el préstamo. El prestamista.
Precio que se paga por el uso de un inmueble (bienes raÃces). El alquiler es el factor más importante de un contrato de arrendamiento. Se puede cubrir el alquiler en efectivo, servicios u otras especies de valor.
El pago paulatino de un adeudo mediante abonos periódicos. Mayormente las hipotecas exigen el pago de cuando menos algo de amortización de su monto principal junto con el pago de intereses, de tal modo que con el tiempo quede saldado el préstamo.
Pago en efectivo que cubre la diferencia entre el monto que se pide en préstamo y el precio de la propiedad. Pocos créditos o préstamos hipotecarios cubren el costo total de la propiedad, aún cuando se combinen con alguna hipoteca secundaria. Lo más probable es que el prestatario o acreditado tenga la necesidad de aportar efectivo, destinado en parte a cubrir los costos de la operación y en parte en calidad de anticipo. Con frecuencia es fuerte el anticipo, ascendiendo a miles o a decenas de miles de dólares.
Depósito que ofrece el comprador de bienes raÃces a fin de hacer constar su buena fe. Las arras deberán acompañar la oferta de comprar la propiedad. Generalmente el corredor, abogado o aseguradora de tÃtulos deposita el dinero en una cuenta por separado fuera del alcance de los tratantes mientras no se realice el contrato.
El que da en arrendamiento a otro una propiedad conforme a un contrato de arrendamiento; casero.
El que toma en arrendamiento una propiedad conforme a un contrato de arrendamiento; un inquilino.
Opinión respecto al valor de una propiedad o la estimación de su valor. Si el comprador ignora el valor de las propiedades de un sector, es prudente exigir como condición del contrato de arras, un avalúo que ascienda cuando menos al monto del precio de venta. Asimismo, los prestamistas exigen avalúo como precondición al otorgamiento de préstamos. El prestatario cubrirá el costo del avalúo.
B
Un terreno con todas sus mejoras de tipo permanente; lo mismo que inmueble o propiedad raÃz. Se distingue entre bienes muebles y bienes raÃces. Hace mucho tiempo los bienes raÃces eran la única fuente de riqueza, que debido a su importancia lograron un trato especial por ley.
C
Saldo del adeudo pendiente que corresponde al préstamo o crédito. El capital del préstamo o crédito, determina el monto de los intereses a pagar. Durante la vigencia de un crédito hipotecario, disminuye el capital, siendo menor la porción de cada uno de los abonos sucesivos correspondiente a intereses.
Persona a la que se traspasa la titularidad de un inmueble; o sea, el comprador.
Formalización del traspaso de titularidad o dominio que efectúa la parte vendedora a favor de la compradora. El contrato de compraventa señala fecha de cierre, momento (de no modificarse) en que se verificará un encuentro entre compradora, vendedora asà como los agentes, abogados, otorgantes de crédito y demás personas interesadas. En dicho encuentro se procede a cubrir honorarios y comisiones, se otorga el crédito o préstamo, se firman los documentos legales, cubriéndose en su totalidad los gastos de la operación entre otros el anticipo o enganche del comprador, aplicando fondos aportados por compradora y vendedora. Ya tramitado el cierre y otorgados los fondos, pasa la parte compradora a ser dueño de la propiedad.
Contiguo; que toca; que tiene comunicación fÃsica. Véanse adyacente y contiguo. Al describir la proximidad de terrenos, colindante quiere decir que toca la propiedad.
1. Monto de utilidad que le corresponde al corredor de bienes raÃces por concepto de servicios prestados. Las comisiones son la manera en que los corredores de bienes raÃces obtienen sus ganancias. 2. Consejo oficial que vigila el cumplimiento de las leyes relativas a bienes raÃces. La Comisión de Bienes RaÃces del Estado de Texas otorga permisos a corredores y personal de ventas y puede suspender un permiso en casos de conductas determinadas.
El que busca o compra casa.
En contrato de compraventa, la parte que paga el precio de la compraventa, asumiendo la titularidad de la propiedad.
Convenio que celebran partes aptas para la ejecución de ciertos actos a cambio de contraprestación. Se puede obligar el cumplimiento de un contrato válido ante un tribunal de justicia. Todo contrato relativo a bienes inmuebles deberá hacerse por escrito para poder obligar su cumplimiento, salvo contratos de arrendamiento por menos de un año.
Igual al impuesto al valor.
El que cuenta con permiso otorgado por el estado para actuar en representación de mandantes o representantes de inmuebles (bienes raÃces) en operaciones afectando los mismos, conforme a leyes estatales sobre la materia. En la mayorÃa de los estados asà como en el de Texas, es preciso contar con permiso de corretaje para poder actuar en una operación afectando inmuebles en representación de otro. El representante autorizado de ventas de bienes raÃces deberá contar con el patrocinio de un corredor que se haga responsable de los actos del representante de ventas. El corredor se encuentra sujeto a la ley de agencia, que le exige la defensa de los intereses de su mandante.
En una operación afectando bienes raÃces, se trata de los costos relacionados al traspaso de dominio, que en general comprenden comisiones de corretaje, porcentajes de descuento y otros honorarios por concepto de préstamos, costos de avalúo y verificación de crédito, honorarios de abogados, gastos de escritura y derechos de inscripción. En una operación de compraventa de una vivienda fácilmente pueden alcanzar un 10 por ciento o más del precio de venta.
Cuota periódica que se le exige a todo propietario dentro de la zona que cubre la asociación respectiva, y destinada a cubrir el costo de la conservación de áreas comunes y a apoyar las actividades de la asociación. Véanse cuota de condominio y cuota de mantenimiento. Con frecuencia constituyen asociaciones de propietarios las constructoras de condominios o fraccionamientos, pasando posteriormente a hacer entrega de la asociación a los propietarios, una vez vendidas todas las unidades o casas. En un fraccionamiento, la asociación podrá hacerse cargo de la conservación de instalaciones comunes de recreo, o tal vez tenga la única función de vigilar el cumplimiento de limitaciones afectando las escrituras. Cada uno de los compradores en el fraccionamiento, se obliga a observar el reglamento en el momento de aceptar las escrituras amparando la propiedad.
Cuota aplicable a los costos inherentes a la tramitación del préstamo o crédito, misma que cubre el prestatario o acreditado a razón de determinado porcentaje del monto del crédito concedido. Véase Porcentaje de descuento. Con frecuencia se cotizan las condiciones de una hipoteca, “8 por ciento más 1 más 2 puntos”, indicando que se cobran tres puntos de descuento (iguales al 3 por ciento del monto del crédito), considerándose uno de los puntos, la cuota de trámite del préstamo. Si se cobra cuota de trámite de préstamo con el objeto de cubrir determinados servicios, por ejemplo un avalúo o verificación de antecedentes de crédito, es posible que para fines tributarios no quede comprendida entre gastos deducibles por concepto de intereses.
D
El que da en prenda su propiedad en calidad de garantÃa de un préstamo. El prestatario.
La ubicación de la propiedad por calle, número, ciudad y código postal. Deberá aparecer el domicilio de la propiedad adquirida en todo documento legal, entre otros el contrato de compraventa, escritura y contrato hipotecario.
El derecho del gobierno o empresa de servicios públicos a adquirir propiedades necesarias para su uso público mediante la expropiación; al propietario hay que darle compensación justa. Los gobiernos o los que ejercen autoridad oficial pueden adquirir las propiedades que necesitan conforme a la Quinta Enmienda y las constituciones de los estados. El monto de la compensación es materia de negociación.
E
Diligencia judicial en que la propiedad constituida en garantÃa de un adeudo se pone en venta por remate a fin de cubrir el adeudo. La ejecución hipotecaria le da al prestamista la facultad de poner en venta por remate, la propiedad constituida en garantÃa del adeudo. Las partes de un contrato hipotecario deben reconocer sus consecuencias.
Escritura que lleva un convenio en el que el otorgante se compromete a defender al cesionario contra toda reclamación o demanda; suele contener convenios garantizando tÃtulo saneado, ausencia de gravamen y goce pacÃfico. Véanse escritura de garantÃa general y escritura de garantÃa especial.
Documento por escrito, debidamente firmado y entregado, traslativo del dominio de un bien inmueble (bienes raÃces). Véase escritura de compraventa, escritura de garantÃa general, escritura de finiquito, escritura de garantÃa especial.
Evaluación de la susceptibilidad de la persona como sujeto de crédito, con fundamento en sus antecedentes de crédito. Con antecedentes de crédito desfavorables o sin antecedentes, podrá ser difÃcil obtener la autorización de un crédito o préstamo hipotecario. El que nunca ha tomado dinero en préstamo, podrá tener tanta dificultad como el que tiene antecedentes de crédito desfavorables.
G
Afectación de una propiedad, poniéndola en garantÃa del pago de un adeudo, sentencia de ejecución, hipoteca o contribuciones; una especie de carga. El gravamen deja la propiedad en garantÃa de un adeudo. Ciertos gravámenes podrán contemplar la venta de la propiedad a fin de satisfacer el adeudo.
H
Instrumento por escrito que establece un gravamen sobre bienes raÃces en garantÃa del pago de determinado adeudo. La hipoteca permite la satisfacción de un adeudo no cumplido, obligando la venta de la propiedad respectiva.
I
Imposición oficial afectando a personas o cosas. Son muchos los impuestos que afectan los bienes raÃces. Los gobiernos locales suelen imponer un impuesto al valor con base en el valor de la propiedad. El gobierno federal asà como muchos estados cuenta con un impuesto sobre la renta, aunque los operadores de propiedades de alquiler pueden deducir gastos de operación, intereses y depreciación a fin de reducir el monto de sus ingresos gravables.
Documento que lleva una agencia de crédito, describiendo los antecedentes de crédito de la persona. Con frecuencia el que otorga préstamos, pide un informe respecto a los antecedentes de crédito del solicitante. Asimismo, tiene la persona el derecho de analizar su informe de antecedentes de crédito, efectuando las correcciones que procedan.
El que recibe la posesión de un inmueble durante un perÃodo determinado o bien, a voluntad. Véase contrato de arrendamiento.
1. Dinero que se paga por el uso del dinero. 2. Tipo y alcance de una participación.
L
El licenciado en derecho se denomina abogado; persona que ejerce la profesión del derecho. Véase abogado.
Cláusula de la escritura limitando el uso de la propiedad. Por ejemplo, la escritura podrá señalar prohibición de la venta de bebidas alcohólicas en el terreno durante un lapso de 20 años. El comprador en potencia deberá confirmar la ausencia de limitaciones que puedan afectar los usos a que desee destinar el terreno; el vendedor en potencia deberá considerar la conveniencia de limitar el uso del terreno.
M
Método de descripción de tierras que recita los linderos de un terreno, consignando los linderos respectivos con sus puntos de inicio y rumbos desde un punto de partida inicial. Se puede apreciar la descripción por medidas y colindancias en un plano o en el mismo terreno.
Ampliaciones, adecuaciones y reposiciones que aumentan el valor de la propiedad. Las mejoras efectuadas a una casa aumentan el valor catastral ajustado correspondiente a la propiedad, pudiendo reducir el producto realizado del capital al efectuarse la venta de la propiedad. Las composturas, que sirven únicamente para la conservación de su valor, no afectan el valor catastral.
O
Ordenanza por la autoridad municipal o de condado u otra autoridad señalando los usos permitidos del terreno en determinados sectores, por ejemplo habitacionales, comerciales, industriales.
Persona que efectúa el traspaso de un inmueble por escritura; el vendedor o donador.
P
Documento que establece un adeudo, señalando la forma de restituir el mismo.
El que efectúa traspaso de tÃtulo a favor del comprador, a cambio de contraprestación.
Acuerdo entre dos partes o más, disponiendo la colocación de determinados instrumentos o propiedades en poder de un tercero para su custodia, hasta en tanto se ejecute o se cumpla algún acto o condición. Es prudente colocar dinero o propiedades en plica, en lugar de entregarlos a la otra parte en una operación pendiente de realizarse.
Monto que se paga al prestamista en el momento de tramitarse un préstamo, a fin de compensar la diferencia entre la tasa de intereses de mercado y la tasa más reducida que ampara el pagaré. Con frecuencia es exigencia tratándose de financiamiento a través de la FHA o la VA. El porcentaje se mide por puntos equivalentes al uno por ciento del monto principal del préstamo. Deberá pagarse el porcentaje de descuento en efectivo en el momento del cierre. Deberán ponerse de acuerdo comprador y vendedor en el momento de preparar el contrato de arras, determinando al responsable de este gasto.
El precio real que se paga en una operación de mercado; se trata de un dato histórico. El valor de mercado es un concepto teórico, y el precio de mercado es el que realmente se paga.
Banco, asociación de ahorro, banco hipotecario, o persona fÃsica que otorga fondos para un préstamo.
Persona obligada a la restitución de un crédito o préstamo; deudor hipotecario. Los documentos legales que amparan el crédito o préstamo hipotecario señalan con el término prestatario o acreditado al solicitante del crédito o préstamo o al receptor del mismo. Queda legalmente obligado el prestatario o acreditado conforme a los términos del contrato hipotecario.
Determinados derechos que ejerce una persona sobre bienes inmuebles y muebles en forma exclusiva; derechos inherentes al dominio de fortuna. Véanse propiedad raÃz y bienes muebles.
Dinero que se anticipa contemplando una finalidad concreta, con la condición de que sea restituido conforme a un régimen establecido.

Póliza de seguro que se constituye a fin de proteger al titular contra pérdidas resultantes de defectos o vicios que afecten el tÃtulo. Se paga la prima de una sola vez, teniendo valor la póliza únicamente hasta el siguiente cambio de propietario.
Seguro contra siniestros, cubriendo la participación del propietario afectando una casa habitación. Véase seguro.
Un derecho, privilegio o prerrogativa que ejerce una persona respecto a los terrenos de otra; por ejemplo el derecho de una empresa de servicios públicos a instalar sus lÃneas en propiedades ajenas. Las servidumbres facilitan los servicios públicos sin que la empresa respectiva tenga necesidad de adquirir los terrenos. No obstante, el comprador potencial de una propiedad deberá determinar el sitio exacto de las servidumbres a fin de confirmar que no impiden los usos proyectados del terreno.

La superficie de la tierra; cualquier porción de la superficie terrestre. Las definiciones legales con frecuencia distinguen entre tierras y aguas.
Otorgar o pasar titularidad a otra persona. Significa compraventa o traspaso de dominio.
Condiciones y disposiciones que señala un contrato. En un contrato puede entrar de todo siempre que sea lÃcito, formando parte de sus disposiciones.
Constancia de que el propietario de una propiedad tiene posesión lÃcita del mismo; constancia de dominio o titularidad. Con frecuencia se le aplican calificativos tales como absoluto, valedero, sin gravamen, comerciable, defectuoso, o legÃtimo.

Importe en efectivo del conjunto de derechos derivados de la titularidad; la cantidad de una cosa que se dará en cambio por otra. El precio es el valor histórico que se pagó; el valor es una estimación de lo que vale. Con frecuencia se clasifica el valor según su tipo concreto: de mercado, de usuario, de catastro, asegurable, especulativo, etc.
Estimación del valor de una propiedad para fines de aplicación de contribuciones prediales.
El mayor precio que un comprador, a su voluntad pero sin obligación de comprar, estarÃa dispuesto a pagar, y el menor precio que un vendedor, a su voluntad pero sin obligación de vender, estarÃa dispuesto a aceptar. Implica la existencia de muchas condiciones, entre otras: 1. Un mercado abierto y competitivo; 2. Personas tÃpicamente motivadas que actúan en forma prudente e inteligente; 3. Tiempo normal de permanencia en el mercado para el tipo de propiedad; 4. Pago al vendedor en efectivo o su equivalente; 5. Comprador en posibilidades de obtener condiciones tÃpicas de financiamiento disponibles en el mercado. Teóricamente una propiedad debe venderse en su valor de mercado si se expone al mercado por un lapso suficiente de tiempo.
